END USER LICENCE AGREEMENT

1. Welcome. The constituent parts of this website are either owned by, or licensed to, Joe Duffy Dun Laoghaire Limited (“JDDL”). The content of this website is managed by JDDL.

Agreement

2. By using this website you agree these terms and conditions and that they govern your access to, and use of, this website. The agreement (incorporating these terms and conditions only) to use this website is between you and JDDL. We reserve the right at any time, and for any reason, and more than once (if necessary) to change these terms and conditions. Your continued use of this website (or any part thereof) following such change shall be deemed to be your acceptance of such change. Please refer back to these pages regularly to check the terms and conditions governing use of this website. If you do not agree to any change to these terms and conditions, please discontinue using this website.

The software, databases, website, trade marks, service marks, logos, iconography, film, imagery and other content and services originating or hosted from this website are ultimately owned by Dr. Ing. h.c.F. Porsche Aktiengesellschaft (“Porsche”) and/or JDDL and their respective licensors and protected by intellectual property rights (“Porsche Content”).

4. JDDL grants you a personal, non-transferrable and non-exclusive licence to use the Porsche Content in object code format on a single device, provided that, you agree not to copy, modify, distribute, transmit, broadcast, create derivative works, reverse engineer, sell, exploit, securitise any of the Porsche Content, whether, in whole or in part.

5. This website is made available for your personal (non-business, non-commercial) use. You agree to only make use of this website in the manner of a polite, law abiding and reasonable person. When registering to use this website or other service you agree not to impersonate any living, dead or fictitious person. You agree, whether intentionally or unintentionally, not to hack this website or cause this website to become infected with a computer virus or similar uninvited software or otherwise interrupt or interfere with website services.

Each product reference on this website is offered subject to a separate full product description which sets out additional specific conditions related to that product including, without limitation, terms and conditions concerning estimated delivery dates, times, warranties, after sales, service and guarantees. 7. We will take all reasonable care to ensure all details, descriptions and prices of products appearing on this website are correct. Although we aim to keep this website as up to date as possible, the information including product descriptions appearing on this website at a particular time may not always reflect the actual position. As previously mentioned, such product descriptions and other details are available from your local Porsche Centre.

8. If you are uploading content by invitation, we recommend that you do not use this website as your exclusive repository for storing such content. Liability

13. Neither JDDL nor Porsche will be liable to you for:

a. any loss of income, loss of business, loss of or damage to reputation or goodwill, loss of opportunity, or loss of actual or anticipated profits, in connection with or arising out of the agreement;
b. any loss or corruption of data in connection with or arising out of your use of this website or website services;
c. any loss or damage which was not caused by our breach of the agreement or of our legal duty of care;
d. any loss or damage which was not a reasonably foreseeable result of our breach of the agreement or of our legal duty of care. Loss or damage is "reasonably foreseeable" if, at the time we entered into the agreement, such loss was contemplated by you and by us; or
e. any loss or damage suffered by you as a result of your failing to take reasonable precautions against such loss or damage.

14. You agree fully to indemnify, defend and hold JDDL and Porsche, and their respective officers, directors, employees, agents and suppliers, harmless immediately on demand from and against all claims, liabilities, damages, losses, costs and expenses, including reasonable legal fees, arising out of any breach of the conditions by you or any other liabilities arising out of your use of this website.

General

15. Nothing in the agreement shall limit or exclude the liability of any member of JDDL or Porsche for death or personal injury caused by their respective negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be excluded or limited by mandatory law.

16. Your right to use this website subject to these terms and conditions is personal to you and you have no permission to transfer or otherwise deal with any rights or obligations arising in connection with the agreement.

17. This website is intended for customers based in the Republic of Ireland and is therefore subject to the regulatory regime(s) of the Republic of Ireland.

18. The agreement (and all non-contractual obligations arising in connection with the agreement) shall be governed by the laws of the Republic of Ireland, and we agree to submit all disputes between us to the jurisdiction of the courts of the Republic of Ireland.

19. These written terms as agreed comprise the whole agreement between you and JDDL and replace and supersede completely any and all previous agreements, proposals, representations, correspondence or discussions by or between us relating to this website and these website services.  JDDL intends to rely upon only these written terms and conditions, and not any statements or representations made elsewhere, in advertising or directly to you by any of our employees or agents. All warranties, terms, representations or conditions not expressly set out in these terms and conditions do not form part of the agreement and are excluded, with the exception only of those terms implied into the agreement by virtue of statutory or other laws and which terms may not be limited or excluded as a matter of law.

What information do we collect about you?

(1) Information you give to us

We may collect personal data from you when you buy or use our products or services, when your vehicle is connected to our IT systems, when you attend Porsche events or visit a Porsche Centre, a Porsche Design Store or Porsche Experience Centre, sign up to  our newsletters or other subscription services, enter into offers or promotions, interact with us on social media platforms, contact us, make a complaint or use our Websites.

The categories of personal data we may request include your name, occupation, contact information (email, postal address and phone/mobile number), credit card/payment details, driving licence details, vehicle and driving data and general information about you such as your experience with Porsche products and services. We may also keep copies of any correspondence you send us which may include personal data.

You should only give us personal data on behalf of someone else if you have their permission to do so or you know that they would not have any objection to us processing their information in accordance with this Privacy Notice.

(2) Information collected by automated means

We also obtain some of your personal data by automated means, for example, when your vehicle is connected to our IT systems we collect vehicle and driving data, when you enter zones at our premises monitored by CCTV, when you telephone for customer assistance your calls are recorded and when you visit our Websites we collect the IP address of the device you use to connect to the Internet, the geographical location of your device, the browser you are using, the type of device you are using (tablet, mobile, desktop), the URL you came from and the web pages you access.

(3) Information collected from third parties

We may receive personal data about you from the following third parties:

  • We may request information about you from credit reference agencies and fraud prevention agencies to assist us in the provision of our goods and services to you.
  • Porsche Centres operated by  other dealers and licensed to sell Porsche products and services collect your personal data when you contact  them in connection with a purchase or prospective purchase. These dealers may pass this information on to us to fulfil the service you have requested.
  • We may receive information about you from companies in the Porsche Group, including Dr. Ing. h.c.F. Porsche Aktiengesellschaft (Porsche AG) and Porsche Smart Mobility GmbH and other Porsche dealers for the same purposes described in the How We Use Information section below.
  • We may sometimes purchase information about prospective customers from third party organisations for marketing purposes. We will always take steps to ensure that your personal data is only used for these purposes if you have consented to receive marketing materials from us. You can opt out from receiving our marketing communications at any time by following the instructions in any of the messages you receive.

Children's privacy

We will never knowingly collect personal data from individuals under the age of sixteen (16) without first obtaining verifiable parental consent. If you are under the age of 16 you should not provide information to us. If we become aware that a person under 16 has provided personal data to us without verifiable parental consent, we will remove such personal data from our files.

How do we protect your personal data?

We use Transport Layer Security (TLS) 1.1 or higher to protect your online transactions. TLS encrypts the personal data you provide to us before travelling over the internet.
